Use of Information Statement

1. Credit decisions and the prevention of fraud and money laundering

We may use credit reference and fraud prevention agencies to help us make credit decisions and to guard against financial crime. We may also conduct identity checks. Please read the guide before you submit your application. By submitting this application, you are explicitly consenting to the use and disclosure of your personal information for the credit checks and the other checks as described in the guide. In addition, please read the data protection Privacy Notice directly below before you submit your application. If there is any inconsistency between any of the provisions of this Use of Information Statement and the provisions of the Privacy Notice, the provisions of this Use of Information Statement will prevail.

2. Other use and disclosures of your personal information including transfers outside the EEA

We (the Lender, Oodle Financial Services Limited trading as “Oodle Car Finance”) are your data controller for data protection purposes. The Data Protection Act 1998 but which, on and from 25 May 2018, shall be replaced by the General Data Protection Regulation (EU) 2016/679) (the “Regulation”)). Please write to us promptly if any of your contact details change so that we may update our records. You have the legal right to obtain copies of your personal information from us.

Your personal information is collected in this application and whenever you supply it to us, or the dealer through which your saw your chosen vehicle, in connection with our arrangements under this application. We may also acquire it in connection with any further application you make to us, or in any other agreement you enter into with us, and from the third parties described in the guide to which we refer above. We will use your personal information in order to manage your agreement or account with us. We will also use it to respond to your enquiries and other communications from you. In addition, we may use it for our legal and regulatory compliance purposes, in accordance with court orders and for our own internal corporate governance. It may also be used for our market research purposes, including if we contact you to assess our service delivery.

We may disclose your personal information to third parties such as the dealer through which your saw your chosen vehicle and to our group companies and service providers, to our professional advisers, to law enforcement agencies and to regulators, including for the purposes described in this notice. If we transfer, charge or assign your agreement to a third party or if we employ a third party to manage any aspect of your account or agreement with us, we may pass relevant information about you to them. Your personal data may be used for certain other additional purposes, with your specific consent.

Your personal information may be transferred outside the European Economic Area (“EEA”) to countries or territories which do not have adequate protection laws, for instance to our service providers if they are located there. We will seek to take steps with a view to protecting your personal data in those cases, in accordance with the Act. We will retain your personal information for as long as necessary having regard to the purposes for which it is collected (as described in this notice) and as required by applicable laws and regulations. Your personal information may be converted into anonymised form in a way which means you cannot be identified from it and then used for the purposes of information security testing, statistical analysis and to enhance our provision of products and services. Our use of all such data will be in line with our responsibilities under data protection law (as relevant) and we would anonymise it before using it for these additional purposes.
